GENERAL

We are serious about protecting your online privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your data when you visit our landing pages and our Website and use the Services. “We,” “our,” or “us” means Wellness Consulting Group, a Wyoming LLC dba Successful Aging Academy, and its related businesses. “Our site” means the Clinical Intelligence Platform. “You,” “your,” or “User” means you as a licensed health practitioner using the Clinical Intelligence Platform and any services provided by us.

This Privacy Policy hereby incorporates our Terms & Conditions by reference, and its defined terms. BY USING OR ACCESSING THE SITE AND/OR THE SERVICES, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT USE OR ACCESS THE SITE.

WHO THIS POLICY APPLIES TO

The Platform is intended exclusively for licensed health professionals, certified health coaches, functional medicine practitioners, and other qualified wellness professionals (“Practitioners”). It is not intended for use by patients or the general public. If you are a patient, please contact your practitioner directly.

COLLECTION AND USE OF INFORMATION

All information transmitted, printed, or otherwise submitted to Successful Aging Academy via this website shall be deemed to be the property of Wellness Consulting Group and Successful Aging Academy shall be free to use such information for any lawful purpose as detailed herein. We may collect and use information about you in a variety of ways. Examples of the types of data we collect and use include:

Financial Information.

We do not collect and store your financial information such as your payment method (valid credit card number, type, expiration date, or other financial information). If you transact business with us, your financial information is collected by our reputable, PCI-compliant merchant processor (Stripe) who uses secure SSL and tokenization of the data to protect your financial data.

Derivative Data.

Like most website operators, we gather from Users of the Site information of the sort that web browsers, depending on their settings, may make available or that our servers automatically recognize when you access the Site or the Services. That information includes your Internet Protocol (IP) address, operating system, and browser type, and the locations of the websites you view right before arriving at, while navigating, and immediately after leaving the Site; the dates, times, duration, and frequency of your interactions with our Services; search terms, the media files you download, interact with or share, favorites you select, and your navigation path through our Services. Such information is not personally identifiable, but it may still be possible for us to determine from an IP address your Internet service provider and the geographic location of your point of connectivity, as well as other statistical usage data. We may analyze such information to help us better understand how the Site is being used.

Personal Information.

At the time you register with the Site, we may collect “Personal Information” about you, which is information that, without more, can be directly associated with a specific person. Personal Information may include your name, residential or business address, email address, and telephone number, and information knowingly provided by you through online forms, registration forms, and surveys. We also may request information about your professional credentials, business name, and other information relevant to your use of the Platform. You are under no obligation to provide us with Personal Information of any kind, with the caveat that your refusal to do so may prevent you from using certain features of the Site or the Services.

Client Health Data (PHI).

When you enter client information into the Platform, we process and store data on your behalf, including client demographics, laboratory values, symptom checklists, lifestyle intake responses, medication and supplement lists, and genomic data (if provided).

PHI Notice: Client health data entered into the Platform may constitute Protected Health Information (PHI) under HIPAA. You, as the Practitioner, are the HIPAA Covered Entity or Business Associate responsible for ensuring lawful collection and use of client data. You represent that you have obtained all required client authorizations before entering data into the Platform. Successful Aging Academy acts as a service provider processing data on your behalf. No client PHI is used in AI model training.

Email Communications.

We may occasionally use your name and email address to send you notifications regarding new services offered by the Site that we think you may find valuable. We may also send you service-related announcements from time to time. Generally, you may opt out of such emails at the time of registration or by following the unsubscribe link in the email communications, though we reserve the right to continue to send you notices about your account and Services you have requested.

General Use.

We use the Personal Information we maintain about you, and other information we obtain from your current and past activities on the Site to: (1) deliver the products and services that you have requested; (2) manage your account and provide you with customer support; (3) communicate with you by email, postal mail, telephone, and/or mobile devices about products or services that may be of interest to you either from us, our Associates, or other third parties and affiliates; (4) generate AI-powered functional medicine recommendation protocols on your behalf; (5) resolve disputes and troubleshoot problems; (6) measure consumer interest in the Services; (7) inform you of updates; (8) customize your experience; (9) detect and protect us against error, fraud, and other criminal activity; (10) enforce our Terms & Conditions; and (11) do as otherwise described to you at the time of collection.

The Platform integrates with the following third-party services. Each has its own privacy practices; we encourage you to review them. We do not sell your data or your clients’ data to third parties.

DISCLOSURES OF INFORMATION

We may disclose your Personal Information under the following circumstances:

By Law or to Protect Rights.

When we believe disclosure is appropriate, we may disclose your Personal Information: (1) in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud, or other wrongdoing; (2) to protect and defend our rights, property, or safety or those of our Users, our employees, or others; (3) to comply with applicable law or cooperate with law enforcement; (4) to enforce our Terms & Conditions or other agreements or policies; (5) in response to a subpoena or similar investigative demand, court order, or request for cooperation from law enforcement or other government agency; (6) to establish or exercise our legal rights; (7) to defend against legal claims; or (8) as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

Marketing Communications.

Unless you opt out from receiving our marketing materials, we may email you about products and services that we believe may be of interest to you. You may opt out of receiving communications from us by clicking on the “Unsubscribe” link at the bottom of every email we send you, or by sending your request in writing via email to: info@successfulaging.academy

Business Transfers and Bankruptcy.

We reserve the right to transfer all of your Personal Information in our possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of all or a portion of our assets. You acknowledge that any such transfers may occur and that the successor organization or other transferee may decline to honor commitments made in this Privacy Policy.

COOKIES AND WEB BEACONS

Cookies.

Similar to other commercial websites, our website utilizes a standard technology called “cookies” to: (1) keep track of the Services you have used; (2) record registration information regarding your login name and password; (3) record your User preferences; (4) keep you logged into the Site; and (5) facilitate purchase procedures. We also use cookies to track the pages that you visit during each session, both to help us improve your experience and to help us understand how the Site is being used. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site or the Services.

Web Beacons.

We may use web beacons on the Site and in emails to count Users who have visited particular pages and viewed emails, and to deliver co-branded services. Web beacons collect only a limited set of information, including a cookie number, the time and date of a page or email view, and a description of the page or email on which the web beacon resides. They can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered.

Analytics.

We may partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies on the Site through the use of first-party and third-party cookies. If you do not want any information to be collected and used by Google Analytics, you can install a Google Analytics opt-out plugin in your web browser or use the Network Advertising Initiative opt-out tool.

LINKS TO THIRD-PARTY WEBSITES

The Site and the Services may contain links to third-party websites and applications of interest, including advertisements and external services. However, once you have used these links to leave the Site, you should note that we neither own nor have any control over those third-party websites or applications. This Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. Before visiting any third-party websites or using any third-party applications, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website or application.

SECURITY

We use reasonable administrative, technical, and physical measures to protect your Personal Information from loss, theft, alteration, or misuse. These include encryption in transit (TLS 1.2+) and at rest (AES-256), Row-Level Security policies on all database tables, multi-factor authentication (MFA/TOTP), automatic session timeout, and strict PHI exclusion from server logs.

However, please be advised that even the best security measures cannot fully eliminate all risks. Any data disclosed online is vulnerable to interception and misuse by unauthorized third parties. We cannot guarantee that only authorized persons will view your Personal Information. We are not responsible for third-party circumvention of any privacy settings or security measures. In the event of a data breach that affects your data, we will notify you in accordance with applicable law.

CHANGING OR TERMINATING YOUR ACCOUNT

You may at any time review or change the information in your account or terminate your account by going to your account settings or by contacting us using the contact information provided below. Upon your request, we will deactivate or delete your account and Personal Information from our active databases as soon as practicable based on your account activity and in accordance with our deactivation policy and applicable law. We will retain in our files some of your Personal Information to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms & Conditions, and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your Personal Information will be completely removed from our databases in response to your requests unless required by law.

POLICY FOR CHILDREN

The Children’s Online Privacy Protection Act protects the online privacy of children under 13 years of age. The Site and the Services are not directed to children, and we do not knowingly collect or maintain Personal Information from anyone under the age of 13. If we learn that Personal Information has been collected from a User under 13 years of age, we will take the appropriate steps to cause this Personal Information to be deleted from our records. The Platform is intended for licensed health professionals aged 18 and over.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our Users who are California residents to request and obtain from us, once a year and free of charge, information about the Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Information that was shared and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

DO-NOT-TRACK FEATURE

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. Because there is not yet a common understanding of how to interpret the DNT signal, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

PRIVACY POLICY CHANGES

We reserve the right to make changes or modifications to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Version Date” of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification. We encourage you to regularly review this page for any changes to this Privacy Policy.
